The special appeals court has clarified the decision for former prime minister Sali Berisha, his son-in-law Jamarber Malltezi and Fatmir Bektashi. The appeal in a decision of 184 pages says that the decision of the first instance that assigned two measures to Berisha, that of the obligation to appear and detention outside the country, is constitutional.
According to the appeal for this security measure, it is not necessary to request authorization from the assembly because the prohibition to go out of the country and the obligation to appear is not a removal of the MP's freedom, which means it has not been violated without the MP's vulnerability.
Likewise, the decision of the first instance is not one-sided and the right to defend himself was not violated, even his lawyers abandoned the process while the court made all efforts to find a lawyer for Berisha. Also in the decision it is stated that, the court rejected the claims of Bwrishes since at the time of committing the criminal act he held the position of Prime Minister and is currently a member of the Albanian Parliament and may undermine the evidence or the investigation that has just been launched against him for the accusation of corruption.
While regarding the change of measure for Jamarber Mllatezi, the Court of Appeal says that he cannot leave the investigation under the measure of house arrest and it is impossible for him to destroy the evidence.
