In 1872, US President Ulysses S. Grant was arrested by a police officer for speeding in his horse-drawn carriage in Washington. The officer raised his hand to signal them to stop. Grant complied and then followed the officer to the police station.
Did it disgrace his presidency? No, I would even say that it was a very positive act and in favor of democracy. What was unthinkable for the "Sun King" of France, Louis XIV - famous for his saying "L'état, c'est moi" (I am the state) - is appropriate in a system of equality before the law.
The Times reports that a grand jury has voted to indict Donald Trump over his payments to a porn star to not talk about their relationship because it could hurt him during the 2016 presidential campaign. Of course, there are some legitimate questions about this particular process, and while we don't know the details of the charges, after reasonable guesses, we can ask ourselves: Should the first indictment of a former president be made under a new, rebuttable legal rationale? by a judge or a jury?
What do we think about the doubts about this case even among those who have no sympathy for Donald Trump? Do you know what New York District Attorney Alvin Bragg is doing? None of us can be sure of the answer to these questions until we have seen the evidence presented at trial.
And I personally worry that a failed prosecution could embolden Trump. However, I would worry – even more – about the message of impunity that would be sent if prosecutors ultimately backed off because the suspect is a former president.
The former president's close man, Michael Cohen, was sentenced to 3 years in prison for making the payment on behalf of Trump, and a basic principle of justice is that if the courier is punished, then the sender must be punished. That's not always achievable, and it may be difficult to replicate what a federal prosecution achieved in Cohen's case.
But the goal must be justice, and this indictment honors that goal. This is especially true because this is clearly a crime with greater consequences than a typical case of falsifying business records. Because apparently the intent was to influence the outcome of the presidential election, and that may have happened.
When Trump is arrested, he will be fingerprinted, photographed and possibly handcuffed. The question arises: Is it degrading to a democracy to prosecute a former leader? The democratic country most adept at arresting its former leaders is South Korea.
